YOU ACKNOWLEDGE AND AGREE THAT RODEO EVENTS ARE INHERENTLY DANGEROUS.

Risks include, but are not limited to:

* Injury or death from livestock (including bulls, horses, and other animals)
* Equipment failure or malfunction
* Flying debris, dirt, dust, or arena hazards
* Slips, trips, falls, and crowd-related incidents
* Loud noises and sudden disturbances
* Unpredictable animal behavior

YOU VOLUNTARILY AND EXPRESSLY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM NEGLIGENCE.

* Alterra Mountain Company

* Care for Big Bear

* Professional Rodeo Cowboys Association (PRCA)
* Event producers, owners, affiliates, officers, employees, contractors, volunteers
* Sponsors, vendors, exhibitors, landowners, and partners

(Collectively, the “Released Parties”)

FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, OR CAUSES OF ACTION, INCLUDING BUT NOT LIMITED TO:

* Personal injury or death
* Property damage or loss
* NEGLIGENCE, INCLUDING ORDINARY NEGLIGENCE

YOU MAY BE DENIED ENTRY OR REMOVED WITHOUT REFUND FOR:

* Unsafe or disruptive behavior
* Intoxication or impairment
* Violation of any rules, laws, or instructions

* ALL PERSONS AND PROPERTY ARE SUBJECT TO SEARCH
* REFUSAL TO COMPLY MAY RESULT IN DENIED ENTRY WITHOUT REFUND

Guests requiring medically necessary items must obtain PRIOR APPROVAL.

ALCOHOL & ABC COMPLIANCE

The Event strictly complies with all regulations of the California Department of Alcoholic Beverage Control.

By entering, you agree:

* NO OUTSIDE ALCOHOL is permitted
* VALID GOVERNMENT ID is required for alcohol service
* ALCOHOL WILL NOT BE SERVED TO ANY PERSON UNDER 21
* INTOXICATED PERSONS WILL NOT BE SERVED
* EVENT STAFF MAY REFUSE SERVICE AT THEIR SOLE DISCRETION
* ANY ATTEMPT TO PROVIDE ALCOHOL TO A MINOR WILL RESULT IN IMMEDIATE REMOVAL

Violation of alcohol policies may result in:

* Ejection without refund
* Referral to law enforcement

* YOU CONSENT TO EXCLUSIVE JURISDICTION IN THIS VENUE

ENFORCEMENT & FINAL AUTHORITY

The Big Bear Rodeo Committee reserves the right to:

* Determine prohibited items
* Refuse entry to any person
* Remove any individual at any time

ALL DECISIONS ARE FINAL.

DISPUTE RESOLUTION, ARBITRATION & LIMITATION OF LIABILITY
LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW:

THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
ANY CLAIM SHALL BE LIMITED TO THE AMOUNT PAID FOR THE TICKET OR ENTRY

NOTHING IN THIS AGREEMENT IS INTENDED TO WAIVE LIABILITY FOR GROSS NEGLIGENCE, RECKLESS CONDUCT, OR INTENTIONAL MISCONDUCT WHERE PROHIBITED BY LAW.

DISPUTE RESOLUTION REQUIREMENT (MANDATORY PRE-SUIT PROCESS)

BEFORE FILING ANY CLAIM, YOU AGREE TO:

PROVIDE WRITTEN NOTICE OF YOUR CLAIM WITHIN 30 DAYS OF THE INCIDENT
ALLOW THE EVENT 60 DAYS TO INVESTIGATE AND RESPOND
PARTICIPATE IN GOOD-FAITH NEGOTIATION

FAILURE TO FOLLOW THIS PROCESS WAIVES YOUR RIGHT TO PURSUE THE CLAIM.


BINDING ARBITRATION AGREEMENT

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS EVENT SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION.

Arbitration shall be administered by the American Arbitration Association (AAA)
Proceedings shall take place in San Bernardino County, California
California law shall apply

YOU WAIVE THE RIGHT TO A JURY TRIAL OR TO LITIGATE IN COURT.

CLASS ACTION WAIVER

YOU AGREE THAT:

CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, MASS ACTION, OR REPRESENTATIVE PROCEEDING


COSTS & ATTORNEY’S FEES

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE PREVAILING PARTY SHALL BE ENTITLED TO RECOVER REASONABLE ATTORNEY’S FEES AND COSTS
YOU AGREE THAT FRIVOLOUS OR BAD-FAITH CLAIMS MAY RESULT IN YOU BEING RESPONSIBLE FOR ALL LEGAL COSTS

TIME LIMIT TO FILE CLAIM

ANY CLAIM MUST BE FILED WITHIN ONE (1) YEAR OF THE INCIDENT.

FAILURE TO FILE WITHIN THIS PERIOD RESULTS IN PERMANENT WAIVER OF THE CLAIM.

SEVERABILITY (ARBITRATION-SPECIFIC)

IF ANY PORTION OF THIS ARBITRATION AGREEMENT IS FOUND UNENFORCEABLE:

THE REMAINING PORTIONS SHALL STILL APPLY
IF CLASS ACTION WAIVER IS FOUND INVALID, THE ENTIRE ARBITRATION CLAUSE SHALL BE NULL AND VOID

SEVERABILITY

If any provision is found unenforceable, all remaining provisions shall remain in full force.

Unauthorized Resale / Anti-Scalping Policy

Unauthorized Resale Prohibited

Big Bear Rodeo tickets are revocable licenses and remain the property of Big Bear Rodeo until admission to the event.

Tickets may not be advertised, offered for sale, sold, auctioned, brokered, transferred for consideration, or otherwise resold above their original face value without the prior written consent of Big Bear Rodeo.

Big Bear Rodeo actively monitors online marketplaces and reserves the right to investigate any suspected unauthorized resale.

Remedies

Remedies for Unauthorized Resale

If Big Bear Rodeo determines, in its sole discretion, that a ticket has been listed or sold in violation of this policy, Big Bear Rodeo may, without notice:

Cancel the ticket(s) without refund;
Deny admission to the ticket holder;
Void any associated parking passes, VIP credentials, hospitality access, or add-ons;
Cancel all tickets purchased under the same order;
Permanently prohibit the purchaser from buying tickets to future Big Bear Rodeo events;
Report fraudulent or deceptive listings to the applicable resale marketplace for removal.


Liquidated Damages

Administrative Fee

Purchaser acknowledges that unauthorized resale causes significant administrative expense, customer service costs, reputational harm, and disruption to event operations. Accordingly, Purchaser agrees that, in the event of a violation of this policy, Big Bear Rodeo may assess a $500 administrative fee per ticket as liquidated damages, which the Purchaser authorizes Big Bear Rodeo to charge to the payment method used for the original purchase, to the extent permitted by applicable law.

Identity Verification

Big Bear Rodeo reserves the right to require the original purchaser to present a valid government-issued photo ID and the credit card used for purchase before admission. Failure to verify ownership may result in denial of entry without refund.

Fraud

Any attempt to circumvent purchase limits through multiple accounts, aliases, bots, automated purchasing software, or other deceptive means may result in immediate cancellation of all associated orders without refund.

Final Determination

Big Bear Rodeo reserves the sole and absolute right to interpret and enforce these policies. All determinations regarding ticket validity, transferability, cancellation, and admission are final.
